To Whom It May Concern:

Pursuant to the Freedom of Information Act, I hereby request the following records:

A digital copy of the two video files reviewed by DHS-OIG in connection with I17-ICE-LAX-04790.

This video shows the alleged assault by GEO guards of a man detained at the Adelanto Detention Facility in 2016. After viewing the video, OIG conclude the man "fell unassisted" and his allegation of being shoved was unsubstantiated. See Exhibit 4 to ROI in 2022-IGFO-00268 Final Response dated 11/8/22:

Available at: https://www.muckrock.com/foi/united-states-of-america-10/re-release-request-132878/#file-1048601

Previously, DHS-OIG released video records through FOIA after a requester demonstrated the agency had capacity to reasonably segregate exempt portions of the video using Adobe Lightroom software licensed to a public affairs office at ICE. Consequently, the District Court's decision, which Plaintiff appealed, was effectively nullified by the agencies' actions to dismiss the Seventh Circuit appeal.

We seek the same treatment in this case. Please provide the redacted video footage at issue.

The file names of the requested records are: "Fall-front angel-20161126T160730_%T2.dxa" and "Fall-front angel-20161126T160730_%T1.dxa"

We seek designation of this request as falling within the Simple Track and a prompt, complete response.

Thank you!

Subject: Freedom of Information Act Request No. 2023-IGFO-00179 Acknowledgement Letter

Dear Mr. Free:

This acknowledges receipt of your November 14, 2022, Freedom of Information Act FOIA (PA) request to the Department of Homeland Security (DHS) Office of Inspector General (OIG), seeking "A digital copy of the two video files reviewed by DHS-OIG in connection with I17-ICE-LAX-04790" DHS-OIG received your request on November 17, 2022, 2022 and assigned it the following tracking number: 2023-IGFO-00179.

Your request has been placed in the queue for processing in the order in which it was received. Although DHS-OIG's goal is to respond within 20 business days from receipt of your request, the FOIA does permit a 10-day extension of this time-period under 5 U.S.C. ยง 552(a)(6)(B)(i). Due to the need to search for and collect the requested records from field facilities that are separate from the OIG FOIA Office, which processes the request, DHS-OIG hereby invokes the 10-day extension for your request and estimates a response to your request to be provided within 30 business days.

Please note, however, that the actual time required to respond to your request depends on the number and types of responsive records located during our records search. Unfortunately, we cannot predict exactly when your request will be processed, as we currently have a large backlog of requests; however, we are using our best efforts to process all requests with due diligence. We appreciate your patience as we proceed with your request.

Should you have questions, contact us at 202-981-6100 or foia.oig@oig.dhs.gov. Refer to the above-referenced tracking number if you contact us regarding your request. If we require additional information, we will contact you.

Sincerely,

OIG DHS FOIA Team
