This is a request under the Freedom of Information Act. I hereby request the following records:

All contracts (and their amendments) and memorandums of understanding entered into by the Federal Bureau of Prisons for services and activities related to the Big Spring Correctional Center (FCI Big Spring) (http://www.bop.gov/locations/institutions/big/)

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Hello Ms. Raymond,

Thank you for your message. I understand that my requests have been aggregated according to 28 C.F.R. § 16.11(h), which states:

(h) Aggregating requests. Where a component reasonably believes that a requester or a group of requesters acting together is attempting to divide a request into a series of requests for the purpose of avoiding fees, the component may aggregate those requests and charge accordingly. Components may presume that multiple requests of this type made within a 30-day period have been made in order to avoid fees. Where requests are separated by a longer period, components will aggregate them only where there exists a solid basis for determining that aggregation is warranted under all the circumstances involved. Multiple requests involving unrelated matters will not be aggregated.

While I disagree with the interpretation that the requests have been made in succession within a 30-day period in order to avoid assessment of fees, you have not provided me with appeal rights; please provide those materials so that I may properly present my professional, journalistic motivation for submitting each individual request as I have as well as further justification for why only those fees necessitated by a media requester fee status will be willingly provided. In the interim, please provide responsive materials as they become available.

Furthermore, I would like to clarify that the expectation for the definition of "contracts (and their amendments) and memorandums of understanding" shall include those materials referred to by the definition of "contract" and "contract documents" referred to within the contracts themselves, as well as all Requests for Proposal and other bidding materials, including those provided by the bidding Contractor in response.

I'm hoping to get a status update on this request. If multiple contracts are being processed as one request, I would like to clarify that I would prefer to receive materials as they become available. I would also like to clarify that responsive materials to these requests would include:

• the initial Invitation to Bid, Request for Proposal, or equivalent call for contractors
• the responsive materials provided by the winning bidder
• other bidder responses
• the current contract
• all exhibits
• all amendments
