Pursuant to the Freedom of Information Act, I hereby request the following records:

1. ICE ERO All Significant Event Notifications (SENs) and Significant Incident Reports (SIRs) created by ERO Field Office detention staff or Immigrant ICE Health Services Corps (IHSC) staff and transmitted to IHSC’s Medical Quality Management Unit or other custodians responsible for monitoring the quality and timeliness of detained immigrants’s care in custody, between January 1, 2021, and the present, that satisfy all of the following criteria:
(a) Detainee - Involves a detained immigrant in any U.S. ICE facility;
(b) Needing Care — Who required emergent care, chronic care, or a referral for a higher level of care;
(c) Based on DVT or PE or Clot — For one or more of the following conditions, whether a formal diagnosis exists or not: (i) deep vein thrombophlebitis (DVT); (ii) pulmonary thromboembelism; _or_ (iii) blood clot.

Please provide electronic database entries as printouts in PDF format.

2. All IHSC or ERO SENs and SIRs relating to medical issues at the Aurora ICE Processing Center just outside Denver, Colorado, created between April 2022 and the present (which, under applicable FOIA law, means ‘the date on which the agency tasks an adequate search’).

3. Any record showing the number of chronic care patients, special medical needs, or significant detainee illness patients IHSC Headquarters or the IHSC Regional Health Services Administrator was aware of on the morning of October 12, 2022. We will accept a total number in lieu of a redacted list.

Pursuant to 6 C.F.R. 5.5(e), behalf of the Al Otro Lado #DetentionKills Transparency Initiative and community partners representing individuals detained at Aurora, we respectfully seek expedited processing of this request, and make the following statement under penalty of perjury pursuant to 28 USC 1746:
A. On October 14, 2022, ICE announced the death of a 39 year-old man inside Aurora ICE Processing Center.
B. ICE subsequently posted a Detainee Death Report describing his medical treatment and care at Aurora.
C. In the wake of his death, significant questions have arisen as to the safety and appropriateness of the medical services he received in the weeks preceding it.
D. These concerns directly impact humans currently imprisoned inside AIPC, and the medical system serving it.
E. Failure to obtain timely, comprehensive information on IHSC and ICE’s capacity to ensure timely and appropriate medical care may put the health and safety of people inside at further risk.
F. The case has been the subject of widespread media attention, and Congressional demands for preservation of records and a thorough, independent investigation.

Accordingly, we respectfully request expedited processing of this request.

Your request was received in this office on 11/14/2022.Due to the increasing number of FOIA requests received by this office, we may encounter some delay in processing your request. Per Section 5.5(a) of the DHS FOIA regulations, 6 C.F.R. Part 5, ICE processes FOIA requests according to their order of receipt. Although ICE’s goal is to respond within 20 business days of receipt of your request, the FOIA does permit a 10-day extension of this time period. As your request seeks numerous documents that will necessitate a thorough and wide-ranging search, ICE will invoke a 10-day extension for your request, as allowed by Title 5 U.S.C. § 552(a)(6)(B). If you’re able to narrow the scope of your request please contact our office. Narrowing the scope may speed up the search process. We will make every effort to comply with your request in a timely manner.Provisions of the FOIA allow us to recover part of the cost of complying with your request. We shall charge you for records in accordance with the DHS Interim FOIA regulations as they apply to non-commercial requesters.
