Mr. Mackie,

We continue to process your FOIA request 17-F-0273. It is our policy that each request receives prompt attention, and every effort is made to treat all requesters equally. As previously noted, our backlog at the time your request was received was 2,017 open requests. Your request has been tasked for a search for records. Once a search response is received, all releasable records, if any, must be thoroughly reviewed and completely processed prior to their release. As soon as that occurs, you will be sent a formal response letter to your request. Please note the unusual circumstances concerning your request are: (a) the need to search for and collect records from a facility geographically separated from this Office; (b) the potential volume of records responsive to your request; and (c) the need for consultation with one or more other agencies or DoD components having a substantial interest in either the determination or the subject matter of the records. These three factors do
have an effect on the processing of your request. Your patience and understanding in this matter is appreciated.

Good morning,

I have reached out to the office conducting the search for your FOIA request for an estimated completion date. Once I hear from the agency with an estimated completion date, I will provide that date to you. Please understand this will only be an estimate and like all estimates the date is subject to change.

Unfortunately, we have a FOIA backlog of open requests. You may not be aware that our office processes all incoming FOIA requests on a first-in, first-out, basis, a practice which has been recognized by the courts. Your request will be processed in chronological order based upon the date it was received. Department of Defense FOIA Regulation allows agencies with significant pending requests to process those requests in a multi-track processing system, based upon the date of receipt and the amount of work and time involved in processing the request. In fairness to other requesters, we ask your indulgence in allowing us to function in accordance with existing queues for responding to requests. We hope that you can bear with us and understand our problem with volumes of requests.

I appreciate your patience and understanding in this matter and regret this delay and any inconvenience it may bring you. Please contact me if you have any further questions regarding your case.
