This is a request under the Freedom of Information Act. I hereby request the following records:
A publicly filed document in a pending federal criminal case includes a copy of an April 5, 2017 letter from HHS Regional Manager Linda C. Colon to Justin Shafer. The case is United States v. Shafer, case number 3:17-cr-00239 in the US District Court for the Southern District of Texas. The letter, which is at docket number 46-3, includes the notation "Our Reference Number: 17-260688". This document and others from the case are available at https://www.courtlistener.com/docket/6059696/united-states-v-shafer/.
Please provide all documents related to this letter. This would including at least the original submission by Mr. Shafer, all responses by HHS to Mr. Shafer, all internal correspondence and other documents within HHS, and communications between HHS and anyone else. Please redact any patient information, which I understand may be present in Mr. Shafer's submission, which alleged that a medical practice was not protecting the privacy of patient records.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.
