To Whom It May Concern:

This is a request under the Freedom of Information Act. I hereby request the following records:

Pictures of DHS, FBI, local law enforcement and private security personnel with the musical group LMFAO during Super Bowl XLVI in 2012. This request is not intended to include all pictures in which law enforcement and security personnel are visible along with LMFAO, but only those in which the law enforcement or security personnel are posing with LMFAO or visibly and clearly in the foreground with LMFAO. These pictures were discussed at the unclassified 2012 National Homeland Security Conference.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Michael Best

A no responsive documents response.

From: Michael Best

The nature of my request made it clear that the files would not be found by conducting a name search of the Central Records System (although it is difficult to believe that FBI does not have a file on either the event (Superbowl) or the performers (LMFAO)). The search does not meet the standards for a good faith effort to locate the records requested. As stated in my initial request, the existence of these pictures was revealed by government officials at the National Homeland Security Conference.
