RE: ICE FOIA Case Number 2024-ICFO-36605

Dear Requester:

This acknowledges receipt of your 5/16/2024, Freedom of Information Act (FOIA) request to U.S. Immigration and Customs Enforcement (ICE), for records pertaining to Mikhail Sebastian. Your request was received in this office on 5/16/2024.

After reviewing the request, it was determined you are requesting records pertaining to a third-party individual. Please be advised that DHS regulations require, in the case of third-party information requests, a statement from the individual verifying his or her identity and certifying that individual's agreement that records concerning him or her may be accessed, analyzed and released to a third party. See 6 C.F.R. § 5.21(g). Because you have not provided this documentation, your request is not a proper FOIA request, and we are unable to accept your request. Please resubmit the request with a completed copy of the Third Party Consent form, which can be found at https://www.ice.gov/doclib/about/pdf/affirmationDeclaration.pdf and/or form G-639, which can be found at https://www.uscis.gov/sites/default/files/document/forms/g-639.pdf. This request has been administratively closed.

Further, it was determined that the records you may be seeking are not under ICE’s purview and may be maintained by U.S. Customs and Border Protection (CBP). We suggest submitting your request directly to the agency that maintains the records you are seeking. Entry/exit records, apprehensions at the border or Port of Entry, detention by Border Patrol, travel records, and form I-94 records are only available from Customs and Border Protection (CBP). For more information on how to request records from CBP, visit their website: https://www.cbp.gov/site-policy-notices/foia/records.

Also, if you seek records regarding a visa, please contact the U.S. Department of State. For more information visit https://foia.state.gov/.
