To Whom It May Concern:
Pursuant to the Freedom of Information Act, I hereby request the following records:
The complete report described in this summary: https://oig.justice.gov/reports/investigative-summary-findings-misconduct-then-acting-assistant-chief-immigration-judge
The summary describes an acting ACIJ who was accused of having had an inappropriate relationship with a subordinate. It also says that when the acting ACIJ was an IJ, he sent a fake email purporting to be from the EOIR Director to a third party. This is deeply concerning. Immigrants ordered removed by this person have a right to know if he is a biased adjudicator and if anything he did might reflect bias that would have affected their removal proceedings. Accordingly, we intend to obtain through the FOIA and publish the full report.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.
Sincerely,
Matthew Hoppock

Hi Ms. Waller. I received the status update and I am confused. The update references multiple documents being compiled. However, my FOIA only asked for one document - the report referenced in this summary: https://oig.justice.gov/reports/investigative-summary-findings-misconduct-then-acting-assistant-chief-immigration-judge. As I understand it, the report is a single document that is subject to public disclosure and should have been disclosed at the outset. What is more, the statutory deadline has passed. Please confirm that we are not talking about a host of documents that the agency needs to sort through and redact, as I have only requested one document. And inasmuch as you confirm that you have that document in your possession, please produce it post haste. Thank you.
Matthew Hoppock.

For clarification, we are currently processing the requested record, and we apologize for any confusion our interim response letter may have caused.
Thank you.
