Pursuant to the Freedom of Information Act, I hereby request the following records:
A court document alleges that the NRLB has failed to certify the results of the NRLB-supervised election held at Pan American Grain between November and December 2023: https://www.courtlistener.com/docket/68870205/1/pan-american-grain-manufacturing-v-national-labor-relations-board/
Therefore, I request the following documents:
1) Any communications, emails, messages, and attachments exchanged between NRLB Region 12 Director David Cohen and other NRLB Region 12 personnel concerning the certification of the NRLB-supervised election held at Pan American Grain between November and December 2023.
2) Any communications, emails, messages, and attachments exchanged between NRLB Region 12 Director David Cohen, Hato Rey Officer in Charger Vanessa Garcia, Regional Attorney Christopher Zerby and personnel from Pan American Grain and the Teamsters Local Union No. 901 or their lawyers and representatives concerning the certification of the NRLB-supervised election held at Pan American Grain between November and December 2023.

I am writing concerning the above-noted FOIA request received by our office. The fax we received states you initially attempted to file the FOIA request on June 24, 2024 but we did not receive the fax from you until July 22, 2024. In your request, you seek records of communications among Region 12 personnel and between Region 12 personnel and parties associated with an election conducted at Pan American Grain in late 2023. I was hoping to speak with you about this request as I needed to get clarification concerning the specific NLRB case or cases for which you are seeking records. Additionally, if the records sought relate to currently open cases, we may be unable to provide the requested records at this time pursuant to Exemption 7(A) of the FOIA. Once we have clarification concerning the case or cases for which you are seeing records, I can advise you on what records are currently available depending on the case status.
