Dear FOIA Officer,

Under the provisions of the Freedom of Information Act, 5 U.S.C. § 552, I hereby request access to and copies of all records held by the National Archives and Records Administration pertaining to the USS Liberty incident that occurred on June 8, 1967.

For the purpose of this request, the records I seek include, but are not limited to:

1. Any declassified documents, reports, or communications regarding the USS Liberty incident.
2. Transcripts of communications between the USS Liberty and any U.S. government entity on the day of the incident.
3. Records of any investigations conducted by U.S. agencies into the incident.
4. Correspondences between U.S. government officials discussing the incident in the aftermath of June 8, 1967.

Should any portion of the requested records be deemed exempt from disclosure, I request the release of any reasonably segregable non-exempt portions in accordance with 5 U.S.C. § 552(b). If an entire document is exempt, I request a justification, citing specific FOIA exemptions, and provision of an exemption log as per Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973).

Please note your obligation under the law not to destroy any records potentially responsive to this request. Any withholding, redaction, or destruction of responsive records without proper justification constitutes a violation of the FOIA and is subject to litigation, as confirmed in Kissinger v. Reporters Committee for Freedom of the Press, 445 U.S. 136, 150 (1980).

Enclosed is a letter requesting a fee waiver for the processing of this request. As an independent investigative journalist associated with TransparencyReport.pw, I believe that the information I seek is in the public interest and its disclosure contributes significantly to public understanding of the operations or activities of the government.

This is in response to your Freedom of Information Act request dated
December 12, 2023, where you have requested any declassified records
regarding the USS Liberty (AGTR 5) Incident on June 8, 1967 including
communications, transcripts of communications from the ship to other
government agencies, and correspondence between the US Government agencies
about the incident. Your request was received by the Reference Branch
(RR2RR) on December 15, 2023 with the assigned tracking number 24-13240.

We have searched our holdings in Record Group 24: Records of the Bureau of
Naval Personnel, Record Group 38: Records of the Chief of Naval Operations,
Record Group 218: Records of the Joint Chiefs of Staff, and Record Group
457: Records of the National Security Agency and we have located some
materials that are relevant to your topic.

In RG 24, we were able to locate the June 1967
<https://catalog.archives.gov/id/215475147> deck log of the USS *Liberty*
(AGTR 5) on the National Archives Catalog.

In RG 38, we were able to locate files on the *Liberty* Incident in Entry P
25: Records on Attacks, Accidents, and Other Topics of the Office of the
Chief of Information (CHINFO) in Box 2.

In RG 457, we were able to locate a report on the *Liberty* Incident in
Entry A1 9002: Studies on Cryptology in SRH-256: Attack on the *Liberty*.

We are forwarding your request to the National Declassification Center for
a report in RG 218 in Chairman General Earl G. Wheeler (Entry UD 58) for a
report in Box 27: 091 (Israel/UAR-Conflict) (May - June 67), which appears
to be still classified. The National Declassification Center will send you
a separate response to this portion of this request.

We are also going to forward your request to the Center of Legislative
Archives and Lyndon B. Johnson Presidential Library for other materials
created by Congress and held by the White House at the time. These
repositories will send you a separate response to this portion of your
request.

to archival records. The FOIA fee section states that "Nothing in this

providing for setting the level of fees for particular types of records."
[5 U.S.C. 552(a)(4)(vi)]. Accordingly, the NARA fee statute, 44 U.S.C.
2116(c), and implementing regulations at 36 C.F.R. Part 1258, apply
exclusively to your request, under which the National Archives does not
waive reproduction charges for individual requesters. Our inability to
grant you the requested fee waiver does not constitute a denial for the
purposes of the FOIA.

We do not consider this a denial of your FOIA request. However, if you are
