Mr. Morisy,

The Department's electronic case notes indicate the case is still open. The searches are pending. Each case is different and the processing time depends on the complexity of information requested, the location of the information, and the time it takes to review the records.

From: FOIA Status

Mr. Dyer,

The searches are still pending. Each case is different and the processing time depends on the complexity of information requested, the location of the information, and the time it takes to review the records.

Since 2008, the Department has experienced a 300 percent increase in the number of FOIA and Privacy Act requests it receives annually. In Fiscal Year (“FY”) 2015, the Department received nearly 25,000 FOIA and/or Privacy Act requests. To date, in FY 2016, the Department has received 8,500 FOIA and/or Privacy Act requests.

There has also been a marked increase in the number of FOIA lawsuits filed against the Department in recent years. The Department is currently engaged in over 100 FOIA litigation cases, many of which involve court-ordered document production schedules. This significant increase in the number of FOIA lawsuits is drawing on limited and already over-burdened resources and has necessitated the continued realignment of resources to meet court-imposed deadlines associated with this increase in litigation.

Please be assured that every effort is being made to address your interests and respond to your request in a timely manner.

The estimated completion date (ECD) for this case is December 31, 2017.
