Request for Complaints about Donald J Trump

Jordan Lassiter filed this request with the Federal Communications Commission of the United States of America.
Tracking #

FCC-2023-000478

Status
Completed

From: Jordan Lassiter

To Whom It May Concern:

Pursuant to the Freedom of Information Act, I hereby request the following records:

I am writing to update my previous request for access to any and all complaints filed with the Federal Communications Commission (FCC) regarding Donald J Trump during his time as a public figure and/or elected official.

As a supplement to my original request, I would like to cite a relevant court case, Cause of Action v. FTC, No. 13-0124 (D.D.C. 2014), which affirmed the importance of disclosing responsive records in accordance with the Freedom of Information Act (FOIA) in a timely and transparent manner.

Furthermore, I would like to provide notice that any withholding or deletion of responsive records without a lawful basis will result in my pursuit of legal action and complaint to the appropriate authorities. As you are aware, FOIA requires agencies to disclose all non-exempt records in response to a request within a reasonable time frame, and any failure to do so would constitute a violation of the law.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Good Citizen

Dear Arthur Scrutchins,

Thank you for your email regarding my recent FOIA request to the FCC. I attempted to call you at the number provided but was unable to reach you. I appreciate your prompt response to my request and I would like to clarify the scope of my inquiry.

The purpose of my request is to obtain all complaints received by the FCC related to Donald Trump during his time as the President of the United States. Specifically, I am interested in complaints received between January 20, 2017, and January 20, 2021. Please let me know if you require any additional information.

In regards to your mention of the deadline for response, I would like to inform you that the use of "Are you still interested" goes against the guidelines provided by the FOIA. According to the guidelines, agencies should not ask requesters to affirm their interest in the request. Requesters are presumed to be interested in their requests unless they explicitly withdraw the request.

I hope this information helps. Please let me know if you require any further clarification or if there is anything else I can assist you with.

Best regards,
Jordan Lassiter

Dear Mr. Arthur Scrutchins,

I hope this letter finds you well. I am writing to express my gratitude for the opportunity to speak with you earlier today. Our conversation was truly enjoyable, and it was a pleasure to learn from your expertise as the FCC FOIA officer.

As per our discussion, I am submitting a FOIA request to limit the scope of Complaints Lodged Against Donald J Trump during his presidency from 2017 to 2021. I would like to request only the first 300 records of complaints lodged against Mr. Trump. I understand that this may require some time to gather and process, and I would like to request an extension if necessary. If an extension is required, I kindly ask that you notify me in writing.

I appreciate your professionalism and your willingness to assist me with this request. Your prompt attention to this matter is greatly appreciated.

Thank you again for your time and assistance. Please feel free to contact me at any time if you require any additional information or have any questions.

Sincerely,

Jordan Lassiter

Jordan, it was a pleasure speaking with you regarding your recent request for complaints regarding D. Trump. It was my understanding that you would be getting back to me with a clarification about your request. Please let me know by May 12th whether you intend to continue with your request. If I do not receive a clarification by that time your request will be closed. Please note that this will not prevent you from refiling your request at a later time.

Sincerely,

Hi Jordan,

It was a pleasure talking with you on Friday, May 19th about your request. As we discussed, instead of processing your request for the first 300 complaints lodged against D. Trump during his presidency from 2017-2021, you modified your request for complaints where D. Trump’s name is merely mentioned for the time period previously mentioned. If you have any further questions please feel free to give me a call or email me.

Take care,

Arthur
