This is an update to FOIA request 1347943-000. I would like to reopen this request.
Releasing this information is in the public interest because it is likely to contribute significantly to public understanding of the operations or activities of the government and to open agency action to the light of public scrutiny. In addition, it will confirm or refute allegations of government wrongdoing or negligence.
In 1983, the FBI opened up an investigation of Richard Craig Smith, and in the course of that investigation, the agency may have engaged in abuses of its investigative power. According to Smith, the investigation was characterized by lack of coordination between the FBI and CIA, misuse of polygraph tests, and bias in the FBI investigation towards a preconceived conclusion. Releasing these documents will confirm or refute specific statements made by Smith as to the conduct of the FBI in the course of the investigation.
There is generally a diminished privacy interest in information that is already publicly available. Information contained in the FBI interviews from 1983-1984 of Richard Craig Smith has been made public both in court proceedings and in Accused: R. Craig Smith: The Spy Left Out in the Cold, an account of Smith’s arrest and trial. Smith collaborated closely with the author of the book; it is told from Smith’s perspective and contains details of his interviews with the FBI.
In addition, the information requested is more than 30 years old, diminishing the government’s interest in keeping it secret.
Failures in FBI espionage investigations continue to be of public interest; in the past year, there have been two high-profile espionage cases (of Sherry Chen and Xi Xiaoxing) dropped in part because of flaws in the FBI’s investigations were revealed.

Estimated Dates of Completion
Requests are processed in the order in which they are received through our multi-track processing system, and the FBI receives a voluminous amount of requests on a daily, weekly, monthly, and annual basis. Requests are divided into two primary tracks--simple (under 50 pages of potentially responsive documents) and complex (over 50 pages of potentially responsive documents). Our complex requests are further divided into medium, large, and extra-large sub-tracks. Simple track requests typically require the least amount of time to process.
Currently, simple track cases average approximately 181 days from the date of receipt for processing. Requests in the medium processing track are currently averaging 232 days from the date of receipt for processing, those in the large processing track are currently averaging approximately 659 days, and those in the extra-large track are averaging 998 days.
