To Whom It May Concern:

Pursuant to the Freedom of Information Act, I hereby request the following records:

I would like to obtain the current number of "matters" being tracked by the Office of the Whistleblower (OWB). In the 2018 Whistleblower report, the SEC stated:

"OWB tracks whistleblower tips that are referred to Enforcement staff for investigation. OWB currently is tracking over 900 matters in which a whistleblower’s tip has caused a Matter Under Inquiry or investigation to open, or has been forwarded to Enforcement staff for review and consideration in connection with an ongoing investigation."

I would like to obtain information on the current number of matters that OWB is tracking. And if possible a breakdown of the numbers of matters that are categorized as a Matter Under Inquiry, Open Investigation, or Consideration in Ongoing Investigation.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Taylor-Scott Amarel

This should not be aggregated.

The subject matter of this request is different from my previous requests and would result in a separate set of data being disclosed.

The aggregation of these simple requests that are not complex or time consuming appear to be a means to bar me from the FOIA process.

To Whom This May Concern,

I appeal the aggregation of this request.

This request is of a different subject matter compared to other requests and can be completed quickly. Furthermore, it is in the public interest to have these documents released very quickly.

Sincerely Yours,
Taylor Amarel

Thank you for the information.

From: Securities and Exchange Commission

Good morning, Mr. Amarel. Attached are emails this office has sent you concerning the 19-01705-FOIA and 19-01836-FOIA. Both of these FOIAs have been responded to and closed. Sincerely,

From: Taylor-Scott Amarel

Thank you.

Please understand that future requests for the number of "matters" being tracked by the Office of the Whistleblower (OWB) will be filed to improve the transparency and track this number over time. I request that these future requests are not aggregated or counted as duplicates. Although they may be submitted regularly (monthly to quarterly intervals) the responsive data will be different because the number of "matters" being tracked regularly changes as the SEC closes cases and opens new cases.

From: Securities and Exchange Commission

Final responses have already been issued to both of these requests. See attached.
