In accordance with DoD Regulation 5400.7 Freedom of Information Act program,
we are required to provide an interim response.
The FOIA provides for the collection of fees based on the costs of
processing a FOIA request and your fee category. Based on the information in
your request, we have determined your fee category is all other. As a
result, you will be provided the first two (2) hours of search time and the
first one hundred (100) pages free of charge; you are required to pay any
search and duplication costs over and above those amounts. However, if you
would agree to receive all documents electronically, there would be no
duplication costs.
Please be advised that we have 20 duty days to submit a formal response. If
we cannot meet this 20 day suspense you will be notified. We will process

Our organization has a significant number of pending FOIA
requests. Therefore, we implemented a multi-track processing for requests.
Based on the information you have requested, we placed your request in the
Complex processing track. A complex request can take substantial time and
cause significant impact on responding units. Complications and delays are
likely. Records sought are massive in volume. Multiple organizations must
review/coordinate on requested records. Records are classified; originated
with a nongovernment source; are part of the Air Force's decision-making
process; or are privileged.
We estimate we will provide a response to your request within 30
working days. Our policy is to process requests within their respective
tracks in the order in which we receive them. FOIA requests are processed as
quickly as possible. We will advise you if we cannot provide a response
within the FOIA statutory timeline.
Due to the current situation regarding COVID-19, the Freedom of
Information Act (FOIA) Office will be minimally manned until further notice.
FOIA managers will be teleworking and will continue to process your request
to the best of their capability; however, we expect delays in response
times. We appreciate your patience and understanding. We will notify you
once the office is back to normal operations.
The FOIA Fee Restriction prevents DoD Components from charging
commercial or "other" requesters search fees, or representatives of the news
media or educational requesters duplication fees if respond do not occur
within 20 or 30 working days for unusual circumstances (documents not
located with the office processing the FOIA request, the responsive records
are voluminous, or required consultation with another agency). Fee
restrictions do not apply if responsive records total more than 5,000 pages,
and this office has made three or more good-faith attempts to discuss with
you, how to effectively limit the scope of your request.

Cathy, I'm confirming our call, acknowledging that the search and fees may be substantially higher. I agree to fees up to $300, which should allow the search to proceed. Before a final billing is made I would like to request that this is categorized as a noncommerical use and should qualify for waived or reduced fees per a public interest disclosure waiver.
As notes for you and I, this is for the "$5mm lebanon training FA300217D0006" contract only, as that's the only one under Randolph's purview, the rest belong to Wright-Patterson. Thanks.

Avoid terms such as "requesting any and all documents" or “other related information” since this type of request generally requires clarification and responsive documents can include excessive costs and time for search and releasable documents.
