Records obtained from https://enforcedata.dol.gov/ indicate the Town of Chester Fire Department was found in violation of the of the Fair Labor Standards Act (FLSA) on one count with a findings start date on June 12, 2020 and a findings end date on June 9, 2022 with Case ID 1967711. All documents related to Case ID 1967711 are requested including the findings of the investigation and a description of the violation found.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The Wage and Hour Division (WHD) of the U.S. Department of Labor (DOL) received your Freedom of Information Act (FOIA) request dated November 21, 2022, wherein you requested the records obtained from https://enforcedata.dol.gov/ indicate the Town of Chester Fire Department was found in violation of the of the Fair Labor Standards Act (FLSA) on one count with a findings start date on June 12, 2020 and a findings end date on June 9, 2022 with Case ID 1967711, including all documents related to Case ID 1967711 with the findings of the investigation and a description of the violation found.

Investigative case files normally maintained in the District Office in paper form are being sent to the Federal Records Center (FRC) under the Paperwork Reduction Act, to comply with the Office of Management and Budget (OMB) USA government agencies have been instructed to keep paperless records, switching to a digital format by the end of 2022.. Unfortunately because records may be transitioning to the FRC at this time, we may be unable to access records that are in paper form. We will continue to process requests for any records maintained in an electronic format.

As you may know, it has been provisionally placed in our complex processing queue, since you have not narrowed the scope of your request to the (Compliance Action Report) CAR and Narrative. WHD receives a large volume of requests and is experiencing a significant backlog. The current backlog has created an exceptional circumstance and we have been unable to process requests within the statutory twenty-day time frame. If you would like to be moved to the simple queue for faster processing, please narrow the scope of your request to the CAR and Narrative. You have 20 days from the date of this letter to inform us of your decision, otherwise we will continue to process your request in the complex queue.

As defined in [29 CFR ยง 70.40(c)(1)(iii)]we have determined your fee category is representative of the news media requester, as such will be duplications costs, except that the first 100 pages of duplication and the first two hours of search time will be furnished without charge.

We reasonably anticipate that you should receive documents by September 30, 2023. Please know that this date roughly estimates how long it will take the agency to close requests ahead of your request in the queue and complete work on your request. The actual date of completion might be before or after this estimated date.
