Subject matter listing (Utica Police Department)

Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

A copy of the current list by subject matter, of all records in the possession of the agency.

Per NEW YORK PUBLIC OFFICERS LAW, ARTICLE 6, Section 87(3):

"Each agency shall maintain:

[....]

(c) a reasonably detailed current list by subject matter, of all records in the possession of the agency, whether or not available under this article. Each agency shall update its subject matter list annually, and the date of the most recent update shall be conspicuously indicated on the list."

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Please advise whether the attached letter dated December 17 is meant to acknowledge receipt of all four FOIL requests submitted to the Utica Police Department by fax on December 12. To be clear, these are separate from the four FOIL requests submitted directly by email to your attention pertaining to the Office of the Mayor.

Please also advise whether future FOIL requests intended for the Utica Police Department should be sent directly to your attention rather than by fax to the department.

Checking again as to whether all four requests submitted for records of the Utica Police Department have been received. Per our records, the only official acknowledgement is the attached letter. It is unclear as to whether this letter was meant to acknowledge all four requests submitted for records of the Utica Police Department or solely the request for the department's subject matter listing.

Again, to be clear, requests were submitted separately for records of the Utica Police Department and the Office of the Mayor — please advise whether requests submitted to the two agencies have been combined and will be responded to accordingly.

We have received the attached letter signed by Deputy City Clerk Michelle George and dated February 20, 2015.

As explained previously, the request for the subject matter listing is not fulfilled by referring to the NYS Records Retention Schedule. This is an entirely separate document that the state Freedom of Information Law statute requires each agency to maintain.

Here is the relevant portion of the statute, for your reference, NEW YORK PUBLIC OFFICERS LAW, ARTICLE 6, Section 87(3):

"Each agency shall maintain:

[....]

(c) a reasonably detailed current list by subject matter, of all records in the possession of the agency, whether or not available under this article. Each agency shall update its subject matter list annually, and the date of the most recent update shall be conspicuously indicated on the list."

Also attached is the subject matter listing provided by the Utica City School District, as an example of the above document as provided in response to a FOIL request.

Hopefully, this clears up any confusion so that the City of Utica is able to complete these FOIL requests in a timely fashion.
