Pursuant to the Virginia Freedom of Information Act, I hereby request the following records:

My request pertains to obtaining information from the regarding data from Office of the Executive Secretary concerning records of reimbursements for court-ordered competency evaluations. Specifically, I am requesting monthly counts of court-ordered competency evaluations by court, if such data is available. If monthly counts are not available, then annual counts for each court are acceptable. I would like this data for as far back as the Office of the Executive Secretary has it available. If this data can be separated into just competency evaluations vs combination competency and sanity at the time of offense evaluations, then I would ask that these counts go in separate columns.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Mr. Morrissey and Mr. Nash:

I am writing in response to your separate requests for data on the number of competency evaluations ordered by courts in Virginia. Mr. Morrissey, I received your request on May 7, 2024, and Mr. Nash, your more detailed request was received on May 9, 2024. Mr. Nash, in your request you note that you are working in coordination with Mr. Morrissey, and that the request is "a follow up to a previous request." This Office did not receive a prior request from Mr. Nash for competency evaluation information.

Public access to records of the Virginia Judiciary is governed by Part Eleven of the Rules of Supreme Court of Virginia. Requests for records of judicial officers and administrative records should be made in accordance with the procedures set forth in Part Eleven of the Rules of Supreme Court of Virginia. To ensure a timely response, please address your correspondence to my attention as Director of Legislative and Public Relations.

The Office of the Executive Secretary is the administrative office for Virginia's Judicial System. As such, we provide administrative support to the courts in areas such as human resources, fiscal services and information technology. This Office administers the Criminal Fund from which experts are compensated. We are able to provide numbers of payments that were authorized to evaluators for competency evaluations, sanity evaluations, or both based on payments made from the Criminal Fund to certified evaluators.
We are able to provide the reports of such payments by court, by fiscal year, for FY2015 to the present. The estimated cost to provide the reports to you electronically by email attachment is $8.97.
