Pursuant to Virginia Freedom of Information Act, I hereby request the following records:

Emails between the Board of Visitors members mentioning "Rolling Stone", "RS", "Sabrina", or "Erdely" between Nov. 1, 2013 and the time this request is processed. Their UVA-based email accounts are listed here: http://www.virginia.edu/bov/visitorsandstaff.html

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

I am writing to acknowledge receipt of your request for records pursuant to the Virginia Freedom of Information Act (FOIA). Va. Code § 2.23700 et seq. for the following:

· Emails between the Board of Visitors members mentioning "Rolling Stone", "RS", "Sabrina", or "Erdely" between Nov. 1, 2013 and the time this request is processed.

Under FOIA, UVA may recover its actual costs incurred in processing your request (See Va. Code § 2.2-3704(F)). This includes costs incurred in accessing, duplicating, supplying, or searching for the records you have requested, including, but not limited to, the costs of reviewing records to determine whether or not they are public records responsive to your request, exempt under FOIA, or may not lawfully be disclosed pursuant to some other provision of law. When costs are likely to exceed $200, we require advance payment.

I want to make you aware that based on past experience with similar requests, your request will greatly exceed $200. In fact, the actual costs incurred by the University to fulfill a request, similar to yours, for a search of correspondence of the Board of Visitors members over a period of approximately one month exceeded $600. Your request is more extensive since it would require a search of correspondence over a period of 15 months.

Given the cost considerations, please let me know if you would like us to proceed with compiling a cost estimate for you based on your current request, or if you wish to amend your request in an attempt to minimize costs.

Thanks for the follow-up email. I wanted to make you aware that we can produce the requested emails from 11/19/14-11/22/14 at no cost to you since these have been previously produced in response to prior requests.

For emails from 11/17-11/19/14, there would still be costs incurred in accessing, duplicating, supplying, or searching for the records you have requested, including, but not limited to, the costs of reviewing records to determine whether or not they are public records responsive to your request, exempt under FOIA, or may not lawfully be disclosed pursuant to some other provision of law.

Please let me know if you still wish to seek emails from 11/17/14-11/22/14, or if you are willing to amend your request to the 11/19/14-11/22/14 subset that can be released quickly and at no cost to you.

I am writing in response to your recent request under the Virginia Freedom of Information Act (FOIA) Va. Code § 2.23700 et seq. Attached you will find 90 pages of records responsive to your request.

In accordance with FOIA, the University exercised the following exemptions and has not disclosed working papers and correspondence of the president (Va. Code § 2.2-3705.7(2)); scholastic records containing information directly related to an identifiable student (Va. Code §2.2-3705.4(1)) and prohibited from disclosure by FERPA; written advice of legal counsel, work product, and records subject to attorney-client privilege (Va. Code §§2.2-3705.1(2) and 2.2-3705.1(3)); personnel records of University employees (Va. Code §2.2-3705.1(1)); and records compiled exclusively for use in closed meetings lawfully pursuant to § 2.2-3711. (Va. Code § 2.2-3705.1(5).
