This is a Freedom of Information Act and Privacy Act request pursuant to Florida Sunshine Law.

I hereby request the below information for the following Volusia County Building & Code Administration personnel: Kerry Leuzinger, Paul Traider, and Jeff Bergman.

1) Performance evaluations and/or employee reviews for the past 36 months
2) Employer memos, notes and reports from employee's performance evaluations for the past 36 months
3) Write-ups of any internal or external employee disputes filed in the past 36 months.
4) Any complaints or disputes filed or reported via phone, email, letter or other means of communication regarding the employee's conduct during the past 36 months.
5) Videotape or phone video recordings of official activity while in public view during the course of work during the past 36 months.
6) Drug screenings and results, including requests for drug screenings not voluntarily undertaken, for the past during the past 36 months.
7) Mental health evaluations conducted within the past 36 months.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge, processed by a representative of the news media/press, and is not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request.

I would prefer the request be filed electronically, by e-mail attachment if available.

Should my request be refused, kindly provide the specific legislative citation for the rejection, as required by Section 119.07(1)(d) of the Florida Statutes.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within a reasonable time frame, according to Section 119.07(1)(a),(c) of the Florida Statutes.

Good morning Ms. Gonzalez,

The records requests have been received and we have sent you the quotes for all 5 of the different requests and fees must be paid prior to final research and production of records. If you need us to send the quotes again, please let me know.

Also, keep in mind that these fees are solely for the Growth and Resource Management departments research time, etc. The requests involve other departments and those departments will have separate fees.

Once payment is received, we may then discuss the timeline and updates for distributions of records.

If no payment is received in 1 month of receipt, we will close the request and you will need to request the records again. The 5 different requests cannot move forward until payment is received. Please see the attached email where the quotes were sent, as well as a follow up email.

Good afternoon Ms. Gonzalez,

Your requests have been idle for over 2 weeks due to non-payment. If we do not receive payment from you in 1 week from today, all requests will be considered null and void. You will then need to resubmit your requests again to be reevaluated and new fees assessed.

Please find attached an estimate of the fees associated with producing records responsive to your request. Charges are in keeping with Title X, Chapter 119 of the Florida Statutes. If you would like to proceed with the attached estimate, please let us know. Payment must be received before the final search is performed and the records are reviewed for exempt and/or confidential information.

If paying by mail you may send payment by check, money order, or cash (exact change only). Please make checks payable to County of Volusia and mail to:

If you prefer to pay in-person, you may do so at the Treasury and Billing Office located in the Historic Courthouse at 125 W. New York Ave., Room 120, DeLand, FL 32720. Cash, checks and debit/credit cards are accepted. You may also pay by phone by calling the Treasury and Billing office at 386-943-7085, explaining that you are paying a public record request fee and providing the reference number starting with PRR that can be found in the subject line of this email. If paying by debit or with credit card a payment processing fee is charged and retained by our third-party payment processor. The fee for pin debit transactions is $1.95 and the fee for credit transactions is 2.6% with $1.95 minimum charge.

We will be closing this request now due to this and if you would like to still have these records you will need to request the records again, and we will go through the process again. This will start the process all the way over and you will be at the back of the line due to this.
