Communications and contracts – Cybercheck

To Whom It May Concern:

Pursuant to the Florida Sunshine Law, I hereby request the following records:

1. All contracts, licenses, MOUs, MOAs, data agreements, letters of intent, State of Work documents, Scope of Work documents, and other agreement documents since Jan. 1, 2021 between Wakulla County Sheriff's Office and Global Intelligence Inc. (also called Cybercheck or Cybercheck.AI) for the provision of the Cybercheck service.

2. All email exchanges, including attachments, between Wakulla County Sheriff's Office staff and email addresses with the domain "@cybercheck.ai" between Jan. 1, 2021 and the present.

3. All emails, including attachments, between staff of Wakulla County Sheriff's Office that reference Cybercheck or its provider Global Intelligence, sent between Jan. 1, 2021 and the present.

I kindly request that you waive all fees as I am a journalist and the requested records will be used for journalism in the public interest.

If you choose to impose fees, I request a detailed breakdown of the fees, including the hourly wage of each employee involved and an explanation of the employee hours required to fulfil the request.

If you choose to reject this request or redact portions of responsive documents, I ask that you provide a detailed breakdown of the statutory exemptions and associated case law underlying your decision to withhold each/any portions from public review.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thanks for your reply. Just to confirm, we understand you can't provide anything relating specifically to an active criminal investigation. Under Florida Public Records Law (Chapter 119) we're asking for all other records. That includes all other documents – including communications between Global Intelligence/Cybercheck and the sheriff’s office about the product, the contract that was signed (if indeed the Sheriff’s Office is using Cybercheck) and all communication before and after the contract was signed, including marketing emails. Please can I move the date back, and search for all records from 01.01.2022 onwards?

If there is still nothing, is it possible that the records I'm requesting, like contracts and marketing emails, fall under an exemption? If so, which one?

If it is still claimed that none of these records exist from 01.01.2022 onwards, we would like a signed affidavit stating that is true, given that the sheriff's office has talked to the press about working with Cybercheck and Global intelligence in recent years.
