To Whom It May Concern:

On February 17, 2016, I sent e-mail to your agency about a November, 2015, experience I had on a Sounder commuter train involving poor treatment that I, a paid customer, received from someone who may have been an employee of your agency. I received a response eight days later, on February 25, from Jon Highland at Sound Transit Customer Service. Mr. Highland reported that he had forwarded my complaint to other staff and wrote in part, "Please let me know if I can answer additional questions." One hour later, I responded with about a half-dozen questions. Despite my followup requests on March 1 and on March 10 for him to do so, Mr. Highland never answered any of my questions. I am left to wonder if his e-mail is malfunctioning or if he has simply ignored the inquiries from me that he solicited.

Pursuant to RCW Ch. 42.56 (Public Records Act), I hereby request all e-mail and memoranda received by, sent by, or sent on behalf of Jon Highland (Sound Transit Customer Service Supervisor) since February 1, 2016. Please provide electronic records such as e-mail messages in their native electronic format (i.e., please do not create new records by printing electronic records then scanning and assembling the images of the print-outs into a PDF).

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

We have identified 1,706 responsive emails to your request for all emails and memos to and from Jon Highland since 2/1/2016.

Please note we are not including 63 personal emails because they do not meet the definition of a public record under 42.56.010 as they do not relate to the conduct of government, and in any event would be also exempt under 42.56.230(3).

We are also withholding 5 emails that have attached routine employee performance evaluations of subordinate employees with no discussion of misconduct and thereby have no legitimate interest to the public. (See also Tiberino v. Spokane County, 103 Wn App. 680, 13 P3d 1104 (2000)). These emails and attachments are exempt under 42.56.230(3).

We have identified an additional 46 emails that relate to individual ORCA accounts. Some of the information contained in those emails will need to be redacted pursuant to 42.56.330. Once we have completed that process we will contact you again to provide you with those emails.

Lastly, we have identified an additional 66 emails that contain links to additional documents in our Customer Records Management System. We are pulling the responsive documents that follow those links and will provide you with those documents once we have collected them from the system.

We expect to have the next installment ready for you in the next 1-2 weeks.

Please send $3.75 to cover copy and mail charges for the 1,706 responsive emails. Make your check payable to Sound Transit, 401 South Jackson, Seattle, WA 98104 and reference PD16-113 on your check. Once we received payment we will copy the records to a CD and mail it to you. If you would rather review the records here at Sound Transit, please contact me to schedule an appointment during normal business hours.

If we do not receive payment or hear from you by May 6, 2016, we will conclude you no longer want access to the records and will close your request file.

I received your e-mail of April 6, 2016. In it, you requested that I remit $3.75 "to cover copy and mail charges for the 1,706 responsive emails." What copying expenses to you expect to incur?

I remind you that e-mail messages are electronic records. Please provide them in their native electronic format. Please do not create new records (e.g., by printing the electronic records, then scanning the paper records you created in order to create a third, again-electronic, set the records or by assembling message bodies and subsets of message metadata [header fields] into a compilation PDF, etc.).

I did not request a PDF. I requested that you "provide electronic records such as e-mail messages in their native electronic format." PDF is not the native electronic format of Internet e-mail messages. Much of the metadata is lost when you create a new record by combining e-mail messages into a PDF. One cannot load e-mail into e-mail software to search through them like other e-mail, sort by recipient, or view discussion threads when you combine them into a PDF.

Dear Q'Deene Nagasawa:

You sent a PDF (essentially an electronic version of one long printout of message after message) instead of the records in their native electronic format. Imagine if you wanted to search through your own e-mail, and instead of using your mail software to enter a search term, filter by sender, or view a thread messages comprising a distinct conversation, you had to look through a pile of printed copies of those messages. What you provided--a new record that you created--is far less useful to the public than the records themselves, and it is not what I requested. Please send messages in their native electronic format. Please to not charge me again to mail these, but put all the messages from both installments on a disk and send them. I explicitly requested two months ago when submitting my request that you not do precisely what you did.

Please also advice how many records are yet to come.

Additionally, I notice that you have modified my request from "all e-mail and memoranda received by, sent by, or sent on behalf of Jon Highland (Sound Transit Customer Service Supervisor) since February 1, 2016" to "Jon Highland's emails relating to ORCA." Please provide the records I requested.
