Greetings,
Pursuant to the Washington Public Records Act, I request the following records, as pertain to the Sounder passenger rail system:
1. The current conductor certification/qualification plan submitted to and approved by FRA in accordance with 49 CFR 242 (or predecessor regulations).
2. The current engineer certification/qualification plan submitted to and approved by FRA in accordance with 49 CFR 240 (or predecessor regulations).
3. The current passenger train emergency preparedness plan (aka "E-plan") submitted to and approved by the FRA in accordance with 49 CFR 239 for your passenger rail service.
Please include attachments, appendices, etc.
The requested records will be immediately and freely available to the public on muckrock.com, and this request is not being made for any commercial purpose.
I would prefer the request be filled electronically, by e-mail attachment if available, or CD-ROM if not. In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request.

This will acknowledge receipt of your request for the following records:
1) The current conductor certification/qualification plan submitted to and approved by FRA in accordance with 49 CFR 242 (or predecessor regulations);
2) The current engineer certification/qualification plan submitted to and approved by FRA in accordance with 49 CFR 242 (or predecessor regulations);
3) The current passenger train emergency preparedness plan (aka "E-plan") submitted to and approved by the FRA in accordance with 49 CFR 239 for you passenger rail service.
We received your request on October 7, 2019.
We have gathered the Passenger Train Emergency Preparedness Plan in response to item 3 of your request. However, we need to review for potential exemptions under the Security exemption in RCW 42.56.240. With respect to the other items in your request, we will need additional time to identify and gather those responsive documents. Given our staff's current workload and the number of requests we are currently handling, we estimate it will take us an additional four to five weeks to complete our review and identify and gather the other responsive records.
We will contact you again once we have completed our review and search.
