Pursuant to the Michigan Freedom of Information Act, I hereby request the following records:

1. the total number of use of force incidents, separated by type of force and year used in 2021 (for example, information that specifies the number of taser incidents in 2021, baton incidents in 2021, etc.). Please include as part of this a breakdown of how many use of force incidents in each year were related to law enforcement operations and how many were related to correctional/custodial operations.

2. the total number of civilian complaints alleging any form of law enforcement misconduct that were reported and the total number sustained in 2021.

3. the total number of civilian complaints alleging law enforcement use of excessive force that were reported and the total number sustained in 2021.

4. the total number of civilian complaints alleging biased policing or racial profiling that were reported and the total number sustained in 2021.

5. the total number of civilian complaints alleging criminal conduct that were reported and the total number sustained in 2021.

6. the total number of officer involved shootings in 2021, both fatal and non-fatal.

When available, I would appreciate being sent individualized data for each item in this request in spreadsheet format. If individualized data are unavailable, please send information that includes aggregate statistics for the item instead.

Note that my requests for civilian complaints are specifically for civilian complaints alleging police misconduct, please do not include complaints filed by one officer/the department against another officer.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Your request is granted as to existing, non-exempt records of Washtenaw County that fall within the scope of your request. To process your request, the County is providing you with its good faith estimate of a FOIA processing fee of $103.45 to search for, retrieve, review, examine, and separate exempt material, if any. This estimate is at the lowest rate of the person qualified to do the work, plus fringe rates pursuant to the Michigan Freedom of Information Act, see attached Fee Calculation Form. You can pay the deposit by sending a check in the amount of $51.73 to cover the required deposit of the good faith estimated processing fee. At this time please only pay the deposit. If you disagree with the response or fees, you may submit a written appeal specifically stating "fee appeal" and state the reasons for the appeal, to the County Administrator. Again I do not see a name on this communication. ALL communications must have a person /individual showing who is being conversed with. This has been communicated and would be appreciated if adhered with.

To process your request, the County provided you with its good faith estimate of a FOIA processing fee of $103.45. You paid a deposit in the amount of $51.73. The actual associated costs is $103.45 less the deposit of $51.73 leaving a remaining balance due of $51.73. (See attached Fee Calculation Form.) Upon receipt of the balance due, the records will be released by email inclusive of any exempt records, the statutory basis for the exemption of any records or portions of records and your statutory remedial rights, if applicable.

If you disagree with this decision or fees, you may submit a written appeal specifically stating "appeal" and stating the reasons for appeal, to the County Administrator or seek judicial review under Section 10 of the Act within 180 days after the County's final determination. Submit your clearly marked FOIA Appeal to: Washtenaw County Administrator, 220 N. Main Street, Ann Arbor, MI 48107-8645, fax: 734-222-9563 or email: dillg@washtenaw.org<mailto:dillg@washtenaw.org>. Within ten (10) days of receiving a request for an appeal, the County Administrator shall (a) reverse the denial; (b) issue a written notice upholding the denial; (c) reverse in part and uphold in part by written notice; or (d) issue a notice extending by ten (10) business days the time to decide the appeal.

A copy of this request will be kept on file for no less than one (1) year.
