Re: Response to Freedom of Information Law Request
Dear Mr. Parker:
This will respond to your New York State Freedom of Information Law (“FOIL”) request received by me on June 2, 2022, and follows my initial response to you acknowledging receipt of that request dated June 8. I am responding to your request as the Records Access Officer of Watervliet City School District.
Please be advised that your request is granted in part and denied in part. With regard to that portion of your request which is granted, the School District is in possession of records that it believes are responsive to your request. Per your request, copies of those records are being provided to you electronically, and accompany this response.
With regard to that portion(s) of your request which is being denied, please be advised that certain, limited portions of the records that you are being provided with have been redacted as those portions are not subject to disclosure under FOIL pursuant to the exception set forth in Public Officers Law § 87(2)(a). Specifically, that section permits public agencies to withhold records that are “exempted from disclosure by state or federal statute.” One such federal statute is FERPA. FERPA requires every educational agency that receives federal funds to ensure the privacy of student “education records” and only disclose such records (or portions thereof) with the consent of a parent or student over the age of eighteen (or a student who attends a post-secondary institution, regardless of their age). As certain portions of the records that you are seeking are personally identifiable education records of a particular students, they are specifically exempt from disclosure under FERPA and they are similarly exempt from disclosure pursuant to Public Officers Law § 87(2)(a) and your request is denied. In addition, a portion of the provided records have been redacted pursuant to Public Officers Law as the disclosure of those portions of records (personal banking information) would constitute an impermissible breach of personal privacy.
Any appeal of this decision should be made within thirty (30) days, in writing to the District’s Superintendent of Schools, Dr. Donald Stevens. Dr. Stevens can be contacted at 1245 Hillside Drive, Watervliet, NY 12189 or by electronic mail at dstevens@vlietschools.org.
