Pursuant to the West Virginia Freedom of Information Act and the West Virginia Open Governmental Proceedings Act, I hereby request the following records:
Universal Waste disposal records and policies.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Ms. Long:
We are in receipt of your Freedom of Information Act request for "universal waste disposal records and policies," which you faxed on May 7, 2015. I am assuming that you are referring to disposal of electronic devices. The West Virginia Department of Education has no policy or records with respect to this issue. The Department, as a State Agency, follows the surplus property regulations of the Purchasing Division. School districts follow all applicable state, county and municipal regulations. I have attached the Legislative Rule "Covered Electronic Devices Recycling Rule" of the Department of Environmental Protection Waste Management. Otherwise we have nothing responsive to your request. Our obligation to you is at an end.
