I am a member of the news media and request classification as such. I have previously written about the government and its activities, with some reaching over 100,000 readers in outlets such as Gizmodo, MuckRock, Motherboard, Property of the People, Unicorn Riot, and The Outline, among others. As such, as I have a reasonable expectation of publication and my editorial and writing skills are well established. In addition, I discuss and comment on the files online and make them available through non-profits such as the library Internet Archive and the journalist non-profit MuckRock, disseminating them to a large audience. While my research is not limited to this, a great deal of it, including this, focuses on the activities and attitudes of the government itself. As such, it is not necessary for me to demonstrate the relevance of this particular subject in advance.

As my primary purpose is to inform about government activities by reporting on it and making the raw data available, I request that fees be waived.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Covid-19 was received on April 23, 2020 and reviewed on April 27, 2020.

I did not hear back from you on an extension so I am including information
pertaining to your request that will hopefully address your questions. You
may find information regarding Wyoming's response and updates to Covid 19

The WDOC website will have any updates regarding WDOC and Covid 19 at
corrections.wyo.gov. Outside of the attached document, I must deny your
request for the following two reasons.

First, the WDOC has developed detailed emergency plans for our facilities
regarding Covid 19 but I must deny the release of WDOC emergency plans and
documents related to our response to Covid 19 under Wyo. Stat.
16-4-203(b)(vi) *“To the extent that the inspection would jeopardize **the
security of any structure owned,** leased or operated by a governmental
entity, facilitate the planning of a terrorist attack or **endanger the
life or physical safety of an individual**,”* Our reasoning for this denial
is that these documents contain detailed plans by our department regarding
the response, housing location and security measures that will be utilized
inside our prisons. The release of these documents could endanger our
operations and allow inmates to manipulate our system.

Second, Wyo. Stat. 16-4-202(d)(iii) states: "A governmental entity shall
not be required to compile data, extract data or create a new document to
comply with an electronic record request if doing so would impair the
governmental entity's ability to discharge its duties." Much of the
information you have requested does not exist, is not tracked or is not in
a format conducive to disclosure. Tracking down this information and
complying would negatively impact the WDOC by taking an already short
staffed administration away from important duties.
