From: Russel Neiss

To Whom It May Concern:

Pursuant to the Georgia Open Records Act, I hereby request the following records:

Copies of any email communications and their attachments sent to or received by Governor Brian Kemp, Trey Kilpatrick, David Dove, Lauren Curry, or Bert Brantley from January 1, 2022 to the present that contain any of the following case non-sensitive keywords: "IHRA", or "antisemitism", or "HB 1274"

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Sincerely,

Russel Neiss

Hi,

Thanks so much for the prompt response.

Two quick questions:
1. I've filed a similar request with a handful of other agencies and have noticed that a fair number of the responses are form letters from the domain: p2a.co -- if we exclude communications from that domain does that dramatically change the number of responsive records? (If so, please do so).

2. Can you explain the estimate of $152.03. It's my understanding that an agency may not charge a search or retrieval fee unless it poses “an unusual administrative cost or burden.” McFrugal Rental v. Garr, 262 Ga. 369, 418 S.E.2d 60 (1992). Is there something particularly challenging or unusual about this request?

Thanks so much,
Russel

The search was performed using your provided date range and parameters. The search yielded an estimated 105 pages as a result. To fulfill your request, we must undergo a legal review of the records for confidential, exempt, or priviledged in accordance with, but not limited to O.C.G.A § 50-18-72, et seq. Excluding the first fifteen minutes of review, the estimated cost of fulfilling your request, at the lowest possible rate and without charging a per page fee, is $152.03. please advise if you would like to proceed. Again, this is an estimate.

Thanks for this prompt and very helpful response.

One last question —

How many pages does the search yield If we were to modify the request to explicitly exclude emails received from the domain “p2a.co” so it would read instead as :

‘Copies of any email communications and their attachments sent to or received by Governor Brian Kemp, Trey Kilpatrick, David Dove, Lauren Curry, or Bert Brantley from January 1, 2022 to the present that contain any of the following case non-sensitive keywords: "IHRA", or "antisemitism", or "HB 1274" — please exclude any emails that were sent from the domain “p2a.com”’

I’m happy to pay whatever estimate that modified request yields. Please let me know the updated cost and where to remit payment.

Again, thanks so much for your help.

This is an estimated cost. I will send the invoice once all responsive records have been reviewed by the legal team. I just need to know if charges will be accepted so that I may proceed.

On 5/20/22 I said I would. On 6/6/22 you said the records were already being processed with an estimated timeline at the end of this month.

Is this still the case?

Thank you
