To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, ยง10, I hereby request the following records:

All files relating to the matter of Commonwealth v. John Doe, for which a grand jury was held at Cambridge in the County of Middlesex on January 16, 2003 and for which a subpoena was signed by Assistant Attorney General John A. Grossman on December 31, 2002.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge through the Internet Archive and as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Sincerely,

Michael Best

Emalie Gainey, I emailed you directly, but have received no response. I prefer not to speak on the phone and to keep a written record of all exchanges relating to FOIA and public records requests.

Thanks,

Thank you very much for your response, and for responding by email. It lets me avoid speaking on the phone, which I prefer to avoid, and allows me to refer to the written record so that I can better learn from my mistakes or file follow-up requests.

I apologize for not including more information in my initial request. Looking back at it, I can see how the generic name and dates alone would frustrate your attempts to locate the records.

Here is the additional information that I have:

A transcribed copy of the subpoena may be found at https://cryptome.org/cryptome-log.htm

The subpoena was to Cryptome AKA Cryptome.org (and its operators (John Young and Deborah Natsios) and requested the operators to appear along "with all logs recording the I.P. addresses and/or users who visited "http://cryptome.org/sec-con.htm" between 11/7/02 00:00:00 GMT and 11/14/02 23:59:59 GMT. "

The page for which logs are requested involves the International Information System Security Certification Consortium (ISC)2 and forged emails from "Anthony Baratta, CISSP" <info@isc2.org>. Also involved was "Dorsey Morrow, CISSP" <dmorrow@isc2.org> An alternate email address provided for Anthony Baratta on that page was abaratta@isc2.org

I hope that these names and additional information will enable you to find the records. I'm very grateful for the effort your office has displayed already, and apologize for not providing as much initial information as I could have and should have.

All the best,

Michael
