Pursuant to the Alabama Public Records, I hereby request the following records:
1) Dates of employment for former Montgomery police officer Brandon Hicks while at the Montgomery Police Department;
2) Official positions held by Montgomery police officer Brandon Hicks per year of employment while at the Montgomery Police Department;
3) Annual salary earned by Montgomery police officer Brandon Hicks per year of employment while at the Montgomery Police Department;
4) Any and all police reports, arrest records, and other related reports filed against Brandon Hicks, a former police officer at the Montgomery police department;
5) Any and all complaints, warnings, disciplinary action, and other related documents filed against former police officer Brandon Hicks when he was a police officer in the Montgomery Police Department.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Good afternoon,
Regarding your request for public records. We are unable to process your request at this time.
Pursuant to Alabama law, specifically Code of Alabama ยง12-21-3.1, law enforcement investigative report and related materials, including but not limited to, dash cam, body cam, photographs and evidence collected third parties do not constitute public records. Therefore, they are not subject to disclosure under the Alabama Open Records Act.
Your request for public records requesting information, the city is only required to provide public records to the citizens of the state of Alabama. See McBurney v. Young 133 S.Ct.1709 (U.S.2013). Therefore, the city respectfully denies your Public Record request.
