Pursuant to the Arizona Public Records Law, I hereby request the following records:

1. the total number of use of force incidents in 2022. Please include as part of this a breakdown of how many use of force incidents in 2022 were related to law enforcement operations and how many were related to correctional/custodial operations.

2. the total number of use of force incidents, separated by type of force, in 2022 (for example, information that specifies the number of taser incidents in 2022, baton incidents in 2022, etc.)

3. the total number of civilian complaints against law enforcement that were reported and the total number sustained for 2022.

4. the total number of civilian complaints alleging law enforcement use of excessive force that were reported and the total number sustained for 2022.

5. the total number of civilian complaints alleging biased policing or racial profiling that were reported and the total number sustained for 2022.

6. the total number of civilian complaints alleging criminal conduct that were reported and the total number sustained for 2022.

7. the total number of officer-involved shootings in 2022, both fatal and non-fatal.

8. the total number of people who the sheriff’s department used force against, broken down by race/ethnicity, in 2022.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Below is the process and fee associated with requesting hard copies.

Please note regarding Question 6, it was determined there were 14 external Criminal PSB investigations opened in 2022 and no external Criminal PSB investigations that closed in 2022 with sustained (arrest) findings.

Also note for Question 7, MCSO does not have a report that specifies that the shooting was a fatal or non-fatal shooting.

Referring to Question 8, race/ethnicity is not a required field when submitting a Use of Force report, therefore MCSO is unable to provide a breakdown.

The fee breakdown for hard copies are as follows:

Documents: $.50 for each page

CD’s: $15.00 each

*Please Note: Documents are available for 30 business days from the date of this notice to be picked up and/or reviewed. After 30 business days has elapsed, the request will be closed, and the documents destroyed. In order to obtain requested documents after the 30 business days, a new public records request will have to be resubmitted and reprocessed. All requests are handled in the order they are received. Providing this response will close out this request. Thank you
