I am a Veterans Service Officer in Pennsylvania. I am requesting courts-martial proceedings for Navy veteran David Nathaniel Thorp 190-72-7572 who served from 14DEC2010 to 03OCT2016. He accepted an Other Than Honorable Discharge in lieu of a courts-martial and is receiving benefits from the Department of Veterans Affairs. After reviewing his records and the Administrative Decision from the VA Regional Office in Denver, Colorado, I believe this veteran is in receipt of benefits that he is not entitled. The judgement was based this individual failing several fitness assessments. Service-members are not discharged with an OTH in lieu of a courts-martial for failing fitness tests. In my opinion (concerning the decision), there was lack of information regarding the discharge coupled with the absence of due diligence by the approving authority. By the veterans own admission, he stole night vision goggles. I cannot find a document in his file relevant to the courts-martial or the theft of this sensitive item.
