Pursuant to the New York Freedom of Information Law, I hereby request the following records:
I am writing to request access to the archive of all Twitter Direct Messages, Muted Accounts, and Blocked Accounts for district Twitter accounts. I have attached a screenshot detailing the process for exporting this public information.
To obtain this information, please go to https://twitter.com/settings/account, click on "Your Account", and then click on "Download an Archive of your data". If possible, I would appreciate receiving the entire archive to avoid burdening the district. Alternatively, please provide only the information noted above.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Records Access Appeals Officer,
I am writing to appeal the summary denial of access regarding my Freedom of Information Law (FOIL) request submitted on April 30, 2023, for the archive of all Twitter Direct Messages, Muted Accounts, and Blocked Accounts for district Twitter accounts.
Timeline of Communications:
April 30, 2023: FOIL request submitted.
May 1, 2023: Acknowledgment of receipt by Paula Tibbitts, with a promise to respond within 20 business days.
June 26, 2023: After follow-ups, I was informed by Paula Tibbitts that the information would be provided by July 31, 2023.
Subsequent Follow-ups: Multiple follow-up communications were sent on May 23, June 7, June 22, July 31, August 15, August 30, September 14, September 29, October 16, October 31, November 15, November 30, December 15, January 1, January 16, and January 31, 2024, without receiving the requested information or further updates.
Change in FOIL Contact: It was later discovered that Paula Tibbitts is no longer employed by BOCES as of September 2023, and future FOIL requests should be directed to foil@neric.org. This change was not communicated to me during the period of my request, which may have contributed to the lack of response.
This appeal is based on the failure of Capital Region BOCES to provide the requested records or to issue a formal denial within the timeframe stipulated by the New York Freedom of Information Law. The prolonged silence and lack of communication following the initial acknowledgment and subsequent promise of delivery constitute a de facto denial of access to the requested records.
I understand that personnel changes and administrative updates can affect the processing of FOIL requests. However, the public's right to access information should not be hindered by such transitions. The lack of response and the summary denial of access to the requested records undermine the principles of transparency and accountability that the FOIL is designed to uphold.
Given the above, I respectfully request a review of my appeal and a prompt response to my original FOIL request. If the requested records cannot be provided, I seek a detailed explanation for their unavailability or a justification for denial based on specific exemptions under the FOIL.
Thank you for your attention to this appeal. I look forward to a resolution that aligns with the spirit and letter of the Freedom of Information Law.
