Michael Carlin and SFPUC:

Pursuant to the Sunshine Ordinance and California Public Records Act, I hereby request the following records

1. Exact electronic copies (without further redactions added by PUC, and without any conversion of file format) of all original records provided by AECOM/Parsons ( "AECOM/Parsons" means AECOM, Parsons, its or their joint venture(s)/joint venture board(s) contracting with PUC, and its or their attorneys or other representatives) in response to the May 11, 2021 letter from PUC to AECOM/Parsons (the "PUC Letter", available at https://www.documentcloud.org/documents/20799191-letter , and disclosed as a public record to me by Sup. Mar). The letter indicates such records should have been received by PUC "no later than May 31, 2021." (For example, if AECOM/Parsons provided PUC a Word file, then I want that original Word file.)
2. Exact copies of the communications sent by AECOM/Parsons in response to the PUC Letter (for example, arguing with it, rejecting it, or transmitting the above records in (1)).
3. Exact copies of the communications sent by PUC to AECOM/Parsons with regards to the PUC Letter (for example, clarifying it, negotiating production, replying to their messages from (2) etc.)

Thank you in advance for your anticipated cooperation in this matter.
Provide rolling responses pursuant to SF Admin Code 67.25(d) - you must produce records no later than the end of business you review that record, without waiting for other records.
You may prioritize this over other requests, so you have no excuse not to respond. Given that this is a very narrow request, we will file complaints if they are not timely responded to.

By definition, PUC has actual possession of records sent by AECOM/Parsons to PUC, and there should be no delay in getting this production.

I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Sincerely,

twitter.com/journo_anon

From: twitter.com/journo_anon Public Records Requester

New: Please produce all letters or documents or records (including exhibits/attachments) transmitted by AECOM/Parsons to PUC on June 16, 2021. Remember "AECOM/Parsons" is defined as AECOM, Parsons, its or their joint venture(s)/joint venture board(s) contracting with PUC, and its or their attorneys or other representatives.

Thank you - there is a June 7 and June 16 request from this email address - which one did you just complete?

From: twitter.com/journo_anon Public Records Requester

Actually, there is a problem: the ShareFile links you gave asks for registering and identifying information to view the files.
You cannot require any extra-statutory requirements to access public records. Please remove the registration requirement and give a completely open, public url.

Dear Honorable Members of the Sunshine Ordinance Task Force and Anonymous Requester,

We write in response to Anonymous’ complaint (attached) regarding SFPUC’s production of records on July 28, 2021 in response to Anonymous’ public records requests dated June 7 and June 16.

From: Public Utilities Commission

Dear Anonymous Requester,

We are writing regarding the following two public records requests that you submitted to the SFPUC:

(1) June 16, 2021 request: ”Please produce all letters or documents or records (including exhibits/attachments) transmitted by AECOM/Parsons to PUC on June 16, 2021. Remember "AECOM/Parsons" is defined as AECOM, Parsons, its or their joint venture(s)/joint venture board(s) contracting with PUC, and its or their attorneys or other representatives”
(2) June 7, 2021 request: “I hereby request the following records: 1. Mar). The letter indicates such records should have been received by PUC "no later than May 31, 2021." (For example, if AECOM/Parsons provided PUC a Word file, then I want that original Word file.) 2. Exact copies of the communications sent by AECOM/Parsons in response to the PUC Letter (for example, arguing with it, rejecting it, or transmitting the above records in (1)). 3. Exact copies of the communications sent by PUC to AECOM/Parsons with regards to the PUC Letter (for example, clarifying it, negotiating production, replying to their messages from (2) etc.)”.

As we explained to you in our email dated July 29, 2021, SFPUC did not become aware of your two requests above until July 28, 2021 because they were sent to the SFPUC General Manager’s email address from an e-mail server not properly authorized or trusted to send the e-mail. As soon as we received your request, we promptly responded on July 28, 2021, providing responsive records to both requests.

On July 29, 2021, you wrote that our July 28 response did not include all emails between PUC and the JV but only the PDFs of letters. The SFPUC has conducted a diligent search for the requested emails, which are available to you at this link: https://sfpuc.sharefile.com/d-s7daf272dc17e4801998646a56dc74f2e . We now consider both your June 7 and June 16 requests to be closed.

No.   You have not completed the request.

Those emails have stripped out their embedded attachments and To/From/Cc/Bcc email addresses.
As discussed in the metadata request, you should not be stripping these out.

Please speak to your IT staff.  When you convert an email to PDF using Acrobat it will preserve all the hyperlinks, To/From/Cc/Bcc and embedded attachments so I can associate them with each other.
Please produce an exact copy of these records.

Something fishy is going on here.  You disclosed one or two of those emails as printed scanned Outlook memos, not as PDFs.  Those need to be fixed.

But more importantly: you disclose a conversation between Carlin and the JV/attorneys screenshot attached.
Provide all (apparently twice) supposedly improperly redacted records you received from the JV, and the recall messages, and the recalled messages, if PUC has constructive possession of any of these record in any form.

Dear Anonymous,

We are writing in response to your August 10, 2021 email (please see below). The records in the format you requested are attached. Please note that one PDF was provided in memorandum style because that email was printed as PDF instead of “saved as” a PDF. Additionally, the attached emails between Michael Carlin and the Joint Venture were included in an email chain provided to you. However, as requested, we are now providing additional emails as standalone records.
