Pursuant to the Freedom of Information Act, I hereby request the following records:

Records pertaining to Alphonse D'Arco (aka, "Alfonse" and "Little Al"), a former capo and acting-boss of the Lucchese organized crime family of La Cosa Nostra (LCN).

The death of D'Arco was widely reported in March 2019; please see attached PDF for proof.

Please conduct a search of the Central Records System, including but not limited to the ELSUR Records System, the Microphone Surveillance (MISUR) Indices, the Physical Surveillance (FISUR) Indices, the Technical Surveillance (TESUR) Indices, and Counterdrug Information Indices System (CIIS), for both main-file records and cross-reference records for all relevant names, individuals, agencies and companies.

If any potentially responsive records have been destroyed and/or transferred to NARA, then I request copies of the destruction or transfer slips as well as any other documentation relating to, mentioning or describing said transfer or destruction, to include but not be limited to confirmation that the Bureau has no other copies of said records.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Estimated Dates of Completion
Requests are processed in the order in which they are received through our multi-track processing system. Requests are divided into two primary tracks--simple (under 50 pages of potentially responsive documents) and complex (over 50 pages of potentially responsive documents). Complex requests are further divided into medium, large, and extra-large sub-tracks based upon request size. Simple track requests typically require the least amount of time to process. Currently, simple track cases average approximately 138 days from the date of receipt for processing. Our complex requests in the medium processing track are currently averaging 571 days, large processing track are currently averaging approximately 1,289 days, and extra-large processing track are currently averaging 1,649 days for processing.

To whom it may concern,

This is in response to an ongoing FOIPA request, given Tracking # 1445687-000, originally sent in August 27, 2019. The FBI FOIA vault states "The FOIPA number entered has been closed, and appropriate correspondence has been sent to the address on file."

On September 8, 2023 I received an email stating that the Bureau sent me a response in May 2023 –my assumption was that this was a long awaited production of records. I informed the Bureau I had received no such response and asked for it to be re-sent.

Today I received an email of two linked PDF's; these are only acknowledgments dated from 2019 without any documents. I believe you can understand that after a four year wait, this is confusing and frustrating.

I would like to have it clarified whether the Bureau, in May 2023, made a production, or if I just got a 2019 acknowledgment letter for no apparent reason?

If the documents are ready, then may I please get the actual documents and not just the acknowledgment letters?

If this is not the case, then this correspondence should serve as notice of appeal of the Bureau's inappropriate and rude closure of the FOIPA case, with a request to remand the request with instructions not to properly search for records and produce them.
