To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

-All policies regarding Taser deployment.
-All policies regarding the keeping of statistics and data concerning the deployment and use of Tasers.
-Any relevant reports (after-action, etc) regarding the individual cases that a Massachusetts State Police officer used a taser.
-All data kept on the deployment of tasers within the department. This includes any data on how many are used, which divisions receive them, what circumstances require tasers, and how often they are used.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Please consider this the City of Westfield’s response to your request made pursuant to M.G.L. c. 66, Sec 10, the Public Records Law.

In my capacity as Records Access Officer, I have made every reasonable effort to retrieve all of the documents that were requested and in the City’s possession and control. Pursuant to the new public records law, we have 10 business days to comply with the request. You requested the following:

--All policies regarding Taser Deployment.
--All policies regarding the keeping of statistics and data concerning the deployment and use of Tasers.
--Any relevant reports (after-action, etc.) regarding the individual cases that a Massachusetts State Police officer used a Taser.
--All data kept on the deployment of Tasers within the department. This includes any data on how many are used, which divisions receive them, what circumstances require Tasers, and how often they are used.

Please find attached the documents that may be responsive to your request.

The City of Westfield is not charging any fees associated with the costs of searching and producing said records.

Please be advised that if you feel that the City has not complied with the Public Records Law’s requirements, you have the right to appeal to the Supervisor of Public Records pursuant to M.G.L. c. 66, § 10A (a) and the right to seek judicial review of an unfavorable decision by commencing a civil action in the superior court pursuant to Section 10A(c).
